Everlight Digital Terms of Use
These Terms of Use ("Terms") form a binding agreement between you and Everlight Digital LLC ("we", "us", "our") and govern your use of our mobile apps and web services, including:
- Olive — family organizer
- Halcyon — weather app with radar
- Shepherd — pastoral-care platform for churches (web service)
- Persue Bible — Bible reader with reading plans
- Persue Prayer — prayer journal and devotional app
- Regen — recovery and training-load dashboard
- WordFind — daily word-search puzzle
- Locus — commonplace book and quote capture
- Common Grace Companion — Reformed study and discernment
- Pasture — cattle and livestock tracker (a separate livestock app, distinct from the Shepherd church-care service)
Some products (such as Shepherd) are web services rather than App Store apps; for those, the Apple-specific terms in Section 15 do not apply, and the business/church terms in Section 19 govern.
By downloading, installing, or using any of our apps you agree to these Terms. If you do not agree, do not use the apps.

1. License
Subject to these Terms, we grant you a personal, limited, non-exclusive, non-transferable, revocable license to download and use the apps on Apple-branded devices you own or control, for your personal, non-commercial use. All other rights are reserved.
You may not copy, modify, decompile, reverse-engineer, redistribute, rent, lease, lend, sell, or sublicense the apps except as permitted by applicable law or these Terms.
2. Account and Eligibility
Some apps require an account. You agree to provide accurate information and to keep your credentials secure. You are responsible for activity under your account.
You must be at least 13 years old (or the minimum age of digital consent in your country) to use the apps. Family-sharing features in Olive permit a parent or guardian to create profiles for children under 13 within their household; see the Privacy Policy for details.
3. Subscriptions, Auto-Renewal, and Billing
Several apps offer optional paid subscriptions ("Pro", "Plus", "Ad-Free", or similar tiers) sold through the Apple App Store.
- Billing. Payment is charged to your Apple ID at confirmation of purchase.
- Auto-renewal. Subscriptions automatically renew at the same price and period unless auto-renew is turned off at least 24 hours before the end of the current period.
- Renewal charge. Your Apple ID is charged for renewal within 24 hours prior to the end of the current period.
- Managing your subscription. You can manage and cancel subscriptions in your Apple ID account settings (Settings → [your name] → Subscriptions on iOS). Deleting the app does not cancel a subscription.
- Free trials and introductory offers. If a free trial or introductory price is offered, any unused portion is forfeited when you purchase a subscription, where applicable.
- Price changes. We may change subscription pricing. You will be notified in advance as required by App Store policy, and continued use after the effective date constitutes acceptance.
Current prices and feature lists are shown in-app on each app's paywall and on its App Store listing.
4. Refunds
All purchases are processed by Apple. Refund requests are handled by Apple under the App Store Terms of Service. Submit requests at reportaproblem.apple.com. We cannot issue refunds directly.
5. Your Content
You retain ownership of the content you create in the apps (tasks, notes, prayers, quotes, journal entries, livestock records, photos, etc.). You grant us a limited license to host, store, transmit, sync, and display that content solely to operate the apps for you.
We do not claim ownership of your content and we do not use it to train AI models. See the Privacy Policy for what we collect and why.
6. Acceptable Use
You agree not to use the apps to:
- Violate any law or third-party right;
- Upload unlawful, harassing, infringing, or harmful content;
- Attempt to gain unauthorized access to our systems or other users' accounts;
- Interfere with, disrupt, or overload our infrastructure;
- Reverse-engineer, scrape, or build a competing product from the apps;
- Abuse AI features (prompt injection, generating disallowed content, automated bulk querying).
7. AI Features
Some apps include AI-assisted features (for example, Olive's natural-language quick-add and weekly review, Clarity-derived planning, Regen's coach notes, Common Grace Companion's tradition-aware study, Locus's quote parser, Pasture's intents). These features call third-party AI providers through a server proxy operated by us; your API requests are not billed to you.
AI output is generated probabilistically and may be inaccurate, incomplete, or out of date. You are responsible for verifying anything important before acting on it. We do not warrant AI output and you should not rely on it for medical, legal, financial, theological, agricultural, or safety-critical decisions.
8. Health, Medical, and Financial Disclaimers
Regen displays recovery and training-load information derived from Apple HealthKit data. It is a fitness and informational tool, not a medical device, and does not diagnose, treat, cure, or prevent any disease. Always consult a qualified clinician before changing exercise, sleep, or medical routines.
Common Grace Companion provides theological education and discernment tools. Content reflects historical Reformed sources and is not pastoral counsel, professional advice, or a substitute for your own church community.
Pasture provides record-keeping and reminders for livestock operations. It is not veterinary, legal, tax, or accounting advice.
9. Third-Party Services
The apps may integrate with third-party services including Apple (App Store, Sign in with Apple, HealthKit, WeatherKit, CloudKit, iCloud, Calendar, Reminders), Google (Sign-In, Calendar, Sheets), Firebase, Anthropic, RevenueCat, AdMob, OpenWeather, and others. Your use of those services is governed by their own terms and privacy policies. We are not responsible for third-party services.
10. Intellectual Property
The apps, including software, design, text, graphics, and trademarks, are owned by Everlight Digital or our licensors and are protected by U.S. and international law. Nothing in these Terms transfers ownership of the apps to you.
Scripture quotations in Persue Bible, Persue Prayer, and Common Grace Companion are used under license or in the public domain; redistribution outside the apps is not permitted without separate authorization from the rights holder.
11. Termination
You may stop using the apps and delete your account at any time from within the app (where applicable) or by contacting us. We may suspend or terminate your access if you violate these Terms or use the apps in a way that creates risk or legal exposure for us or other users. Sections that by their nature should survive termination (license restrictions, IP, disclaimers, liability, indemnity, governing law) survive.
12. Disclaimer of Warranties
The apps are provided "as is" and "as available" without warranties of any kind, whether express, implied, statutory, or otherwise, including warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy, or uninterrupted availability, to the maximum extent permitted by law.
We do not warrant that the apps will be error-free, that defects will be corrected, or that data will be preserved without loss.
13. Limitation of Liability
To the maximum extent permitted by law, in no event will Everlight Digital, its owners, contractors, or licensors be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, lost data, business interruption, or loss of goodwill, arising out of or related to your use of the apps, even if advised of the possibility of such damages.
Our aggregate liability for any claim relating to the apps will not exceed the greater of (a) the amount you paid us for the app or subscription in the twelve months preceding the claim, or (b) US $50.
Some jurisdictions do not allow these limitations; in those jurisdictions our liability is limited to the smallest amount permitted by law.
14. Indemnification
You agree to indemnify and hold harmless Everlight Digital from any claim, loss, liability, or expense (including reasonable attorneys' fees) arising out of your content, your use of the apps, or your breach of these Terms.
15. Apple-Specific Terms
The following applies to apps you obtain from the Apple App Store:
- These Terms are between you and Everlight Digital, not Apple. Apple is not responsible for the apps or their content.
- Apple has no obligation to provide maintenance or support for the apps.
- In the event of any failure of an app to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price (if any) for that app to you. To the maximum extent permitted by law, Apple has no other warranty obligation with respect to the apps.
- Apple is not responsible for addressing any claims by you or any third party relating to the apps, including product-liability claims, claims that an app fails to conform to any applicable legal or regulatory requirement, or claims arising under consumer-protection or similar legislation.
- In the event of any third-party claim that an app or your use of it infringes that third party's intellectual property rights, Apple is not responsible for the investigation, defense, settlement, or discharge of that claim.
- You represent that (i) you are not located in a country subject to a U.S. Government embargo or designated as a "terrorist supporting" country, and (ii) you are not listed on any U.S. Government list of prohibited or restricted parties.
- Apple and Apple's subsidiaries are third-party beneficiaries of these Terms, and upon your acceptance Apple will have the right (and be deemed to have accepted the right) to enforce these Terms against you as a third-party beneficiary.
16. Governing Law and Disputes
These Terms are governed by the laws of the State of Texas, United States, without regard to its conflict-of-laws rules. The exclusive venue for any dispute that is not subject to arbitration or small-claims court is in Travis County, Texas. The United Nations Convention on Contracts for the International Sale of Goods does not apply.
You and Everlight Digital each agree to resolve disputes individually, and not as part of a class, consolidated, or representative action, to the maximum extent permitted by law. Nothing in this section prevents either party from seeking injunctive or equitable relief for the protection of intellectual-property rights.
17. Changes to These Terms
We may update these Terms as the apps evolve. Material changes will be announced in-app or by updating the "Last updated" date above. Continued use of the apps after the effective date constitutes acceptance.
19. Shepherd (Churches) — Business Terms & Data Processing
Shepherd is a pastoral-care web platform used by churches and is a business-to-business service. The following terms apply to it in addition to the general terms above; where they conflict for Shepherd, this section controls.
- Who agrees. By signing in to Shepherd you accept these Terms on behalf of your church or organization (the "Church"), which is responsible for activity in its account.
- Controller and processor. For information about the Church's members and community stored in Shepherd, the Church is the data controller and Everlight is the data processor, acting only on the Church's documented instructions. The Church is responsible for having a lawful basis for the data it stores and for obtaining any required consents — including any parental or guardian consent for information about minors.
- Data-processing agreement. These Terms together with our Privacy Policy form the data-processing agreement between the Church and Everlight. A separately signed DPA is available on request at shepherd@everlight-digital.com. Everlight will not sell Church data or use it to train AI models, and engages the sub-processors listed in the Privacy Policy.
- Text messaging (SMS). If the Church enables SMS, it is responsible for complying with applicable messaging laws (U.S. TCPA and carrier A2P 10DLC): message only consenting recipients, identify the church, and honor STOP (opt-out) and HELP requests. Message and data rates may apply to recipients.
- Billing. Shepherd subscriptions are billed through Stripe per the pricing shown in-app, not through the Apple App Store; the Apple-specific terms in Section 15 do not apply to Shepherd.
- Not professional advice. Shepherd is a record-keeping and care-coordination tool, not medical, legal, or licensed-counseling software, and is not HIPAA-covered. In an emergency call 988 or 911.
- Governing law. Shepherd is operated by Everlight Digital LLC; these Terms are governed by the laws of the United States and the State of Texas, consistent with Section 16.
